2011 Hyundai Sonata Raffle PDF Print E-mail

 

We're raffling off a brand new 2011 Hyundai Sonata courtesy of Fuccillo Automotive Group. The winner will be drawn on Wednesday, November 24, 2010. Tickets are $50 each and may be purchased by calling 518-301-5662 or through mail by sending a check made payable to The Quest for Grace Foundation to 22 Deerfield Court, Rexford, NY 12148. Please indicate the number of tickets you'd like to purchase and include your name, address, phone number and email address.

 

Official Rules and Regulations for the 2010 Car Raffle
By participating in The Quest for Grace Foundation’s 2010 Car Raffle, each participant agrees that:
  1. These rules govern the conduct of the raffle and, together with the decisions of the Quest for Grace Foundation Board, hereinafter referred to as the “Board”, are binding on everyone who purchases a raffle ticket and/or who is named on a raffle ticket. All dates and locations referenced in these rules may be changed in the Board’s sole discretion. Any such changes will be posted on the Quest for Grace Foundation’s website.
  2. The Quest for Grace Foundation’s 2010 Car Raffle is a fund raising activity in support of Foundation’s purpose to raise money to assist individuals by providing alternative family living arrangements and who may provide services for individuals who are in need of alternative living arrangements due to various social impediments. These official contest rules may not be waived, modified or supplemented except by the Board. No modification of these official contest rules shall be enforceable unless made by the Board. The Board’s interpretation and application of the rules and regulations shall be final.
  3. The grand prize for Quest for Grace 2010 Car Raffle is a 2011 Hyundai Sonata donated by Fuccillo Hyundai. Depictions of the car are shown on the Quest for Grace Foundation website (thequestforgracefoundation.org). The retail value of the car is approximately $21,000.00. The car will be transferred to the winner in its “AS IS” condition. The Quest for Grace Foundation does not provide any guarantee or warranty, expressed or implied, in connection with the car. The Quest for Grace Foundation accepts no liability or responsibility regarding the manufacturing or condition of the car. No warranties, express or implied, are made or offered by the Quest for Grace Foundation.
  4. The grand prize drawing for the Quest for Grace 2010 Car Raffle will be held on Wednesday, November 24, 2010 at approximately 10:00 A.M., at the Fuccillo Hyundai car dealership located at 4101 State Street, Schenectady, New York 12304. The winning ticket will be drawn at random from a container containing all eligible raffle tickets. The winner’s name will thereafter be posted on the Quest for Grace Foundation website.
  5. The drawing for the car will be open to the public, but the winner does not need to be present to win. In addition to posting the winner’s name on the Quest for Grace Foundation website, the Quest for Grace Foundation will make reasonable efforts to contact the person named on a winning raffle ticket using only the information on the winning raffle ticket.
  6. The price per raffle ticket is $50.00, and may be purchased solely from the Quest for Grace Foundation. You may buy as many tickets as you wish. A raffle ticket can be purchased in one name only. Each raffle ticket will be entered separately in the drawing. Each raffle ticket is a separate and equal chance to win the grand prize. The position of the Internal Revenue Service (IRS) is that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.
  7. You may purchase a raffle ticket(s) by any of the following methods.
    1. You may send a written request for a ticket(s) and a check payable to The Quest for Grace Foundation to 22 Deerfield Court, Rexford, NY 12148. If you elect this method, your written request must be received by The Quest for Grace Foundation by 11:59 P.M., on Tuesday, November 23, 2010.
    2. You may purchase tickets in person directly from authorized representatives of The Quest for Grace Foundation. If you elect this method, the raffle tickets may be purchased until the drawing takes place on Wednesday, November 24, 2010.
    3. The foregoing deadlines are intended to provide the representatives of The Quest for Grace Foundation adequate time to process your raffle ticket purchase and place your ticket in the container containing all eligible raffle tickets.
  8. The grand prize winner shall assume and must pay all fees and charges (including but not limited to registration, tags, license & delivery costs), local, state and federal taxes when the car is transferred to the winner. In addition, all costs of car ownership, such as, and without limitation insurance, maintenance, repairs and fuel, are the winner’s sole responsibility. The Quest for Grace Foundation assumes no responsibility for the winner’s tax obligations and suggest that the winner consult with a tax advisor. The Quest for Grace Foundation may file a form 1099 with the IRS to report the value of the prize won. If filed, the winner will also receive a copy of this form.
  9. By participating in the Quest for Grace 2010 Car Raffle, all ticket purchasers accept and agree: (a) to be bound by all the rules, limitations and restrictions set forth herein; and (b) that their names and/or likenesses may be disclosed to and used by the news media and may be otherwise be used by the Quest for Grace Foundation for publicity purposes, and the name of the winner may be published in area newspapers or other media including television, radio, web and print. The winner’s name and/or likeness may also be published on the Quest for Grace Foundation website. The winner agrees to the use of his/her name, photograph or videotape likeness and statements for publicity purposes by the Quest for Grace Foundation, and agrees to sign a publicity release, all without any further compensation.
  10. By participating in the Quest for Grace 2010 Car Raffle, each participant releases the Quest for Grace Foundation and each of its directors, officers, employees and agents from any and all liability for injuries, losses or damages of any kind caused by any prize or resulting from acceptance, possession, use or misuse of any prize, and each winner agrees to indemnify and hold the Quest for Grace Foundation and each of its directors, officers, employees and agents harmless from any and all losses, damages, costs, expenses, rights, claims and actions of any kind arising in connection with or as a result of winner’s acceptance or use of any prize.
  11. The Quest for Grace Foundation 2010 Car Raffle ticket purchasers and the person named on raffle ticket must be at least 18 years of age at the time of purchase, and, upon request, must prove his/her age with photo identification such as a driver’s license. The prize winner may also be required to sign an affidavit of eligibility. Any raffle ticket which is purchased by a person that the Board deems, in its sole discretion, to be ineligible, will not be honored.
  12. The prize winner is strongly advised to seek professional legal and tax advice. The award of the prize could have material adverse consequences on the winner including without limitation, with respect to taxes, income, government entitlements or other benefits, or other legal, financial or other matters.
  13. In order for the prize winner to receive the car, if not present at the drawing, he/she must elect to receive the car once drawn by delivering written notice of that election to the Quest for Grace Foundation, 22 Deerfield Court, Rexford, New York 12148, by 5:00 P.M., on Friday December 10, 2010. If Quest for Grace Foundation does not timely receive that written notice, then the prize winner will be automatically and irrevocably deemed to have elected not to receive the car and it will remain the property of the Quest for Grace Foundation. No other raffle ticket will be substituted for the winning raffle ticket.
  14. All raffle ticket sales are final. No refunds will be made. The Quest for Grace Foundation assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or deliver receipts prior to the raffle’s deadlines. A raffle participant’s sole and exclusive remedy for the Quest for Grace Foundation’s breach shall be limited to the return of the purchase price paid for his or her raffle ticket(s). In no event shall the Quest for Grace Foundation or its directors, officers, employees, members, committee members, agents, contractors, advisors, representatives be liable to any party for any loss or injuries to earnings, profits or goodwill, or for any incidental, special, punitive or consequential damages of any person or entity.
  15. This raffle is registered with the New York State Racing and Wagering Board. This offer is void where prohibited by law. All federal, state and local laws and regulations apply.
